Indian Regulatory System

The 2024 Act and India's aviation authorities

India's civil aviation system begins with an Act of Parliament, continues through rules made by the Central Government, and is applied through directions and operating instruments issued by the competent authorities. The Bharatiya Vayuyan Adhiniyam, 2024 replaced the Aircraft Act, 1934 as the principal enabling law.

Who the Act reaches

The Act applies throughout India. It also follows Indian citizens wherever they are, Indian registered aircraft and the persons on board wherever the aircraft flies, foreign registered aircraft and persons on board while in Indian airspace, and aircraft operated by a non-citizen whose principal place of business or permanent residence is in India.

DGCA powers

The Director General is appointed by the Central Government. DGCA continues as the civil aviation regulator, may receive delegated powers, and may issue binding safety directions. Its directions can reach operators, aerodromes, air traffic services, maintenance, aircraft navigation, security and other persons within the Act.

Central Government rule-making

The Central Government has ultimate authority over the statutory bodies and may make detailed rules concerning aircraft design, manufacture, possession, use, operation, maintenance and registration. The power also reaches personnel and service licensing, air transport, fares, aerodromes, communication, navigation and surveillance, air routes, prohibited or restricted areas, dangerous goods, passenger and cargo safety, unlawful interference, accident investigation, public health, land use near aerodromes and implementation of international agreements.

Specific powers include controlling rubbish and animal slaughter within 10 km of an aerodrome, regulating buildings and trees up to 20 km around an aerodrome, detaining an unsafe aircraft, restricting or cancelling licences and approvals, and granting defined exemptions.

Aircraft Rules 1937: entry, aircraft and crew

The Aircraft Rules, 1937 work with the 2024 Act. They convert the broad statutory powers into requirements for aircraft, crew, operations, documents, aerodromes and enforcement.

Scope, nationality and lawful use

The Rules apply across India, to Indian registered aircraft wherever they fly, and to foreign aircraft while operating in or over India. Leased aircraft may be treated according to an agreement under Article 83 bis. An aircraft has the nationality of its State of Registry. No person may operate or assist in operating an aircraft except in accordance with the Rules.

Registration, marks and prohibited flights

An aircraft must be registered and must display its nationality and registration marks together with the owner's name and address as required. An Indian registered aircraft may not leave India for an overseas flight without the required DGCA permission, and it may not fly to territory declared prohibited by Government notification.

Personnel, ratings and documents

Security, aerodromes and sensitive activities

  1. Arms and explosives require written permission from the Central Government.
  2. Passengers and hand baggage must undergo the prescribed security screening before boarding.
  3. Passenger aircraft for hire and scheduled services use licensed or approved aerodromes.
  4. Photography at a DGCA licensed aerodrome or from an aircraft in flight requires the prescribed written permission, unless a notified exemption applies.
  5. Only Category A registered aircraft may normally be used for aerial work or public transport, subject to a written exception.

Prohibited areas and an inadvertent entry

Flight over an area listed in Schedule I is prohibited unless Government permission applies. If a pilot strays into such an area, the response is to signal distress, leave the area and land at the nearest aerodrome. The pilot must not continue farther into the zone or commence descent while still over it.

Registration is not enoughA certificate, mark or licence does not by itself authorise every flight. The operation must also satisfy the rules on aircraft category, crew qualification, area restrictions, documents and any special permission.

Operating safety, conduct and refuelling

National law follows the aircraft from dispatch to parking. It controls airworthiness, conduct, alcohol, dangerous flying, fuelling, carried persons and the safe use of equipment.

Conditions for flight and enforcement

An aircraft may fly only with the required valid certificate of airworthiness or special authority, proper maintenance, compliance with certificate limitations, and the prescribed certificate on board. A non-compliant aircraft may fly only under a Special Flight Permit where Rule 55A permits. Flights follow the rules of the air issued by DGCA. Authorised officials may demand licences, log books and certificates; a document not carried on board must be produced within seven days.

An aircraft may be detained by written order or by practical measures such as blocking access, defuelling or removing parts when an unlawful or unsafe flight is suspected. Registration or airworthiness certification may be suspended or cancelled for violations or unresolved safety doubts. DGCA may restrict a licence or certificate when its conditions are not met or inspection findings remain unresolved.

Special carriage and dropping

A person with a mental disorder or epilepsy may be carried only under the stated medical, alcohol, sedation and attendant conditions. Carriage of prisoners requires written DGCA or authorised-officer permission. Animals, birds and reptiles require DGCA permission and compliance with its conditions. Articles may not be dropped except for stated cases such as ballast, emergency fuel or cargo, message bags, navigation aids, permitted paper or flower petals, and towing ropes. Parachute descent is normally limited to emergencies unless Government permits otherwise.

No person may ride on a wing, undercarriage or another external part not designed for passengers. Temporary access for repairs or safety, and authorised access to a goods compartment, are the stated exceptions. Gliders, kites and remotely piloted aircraft may be exempt from selected provisions, but the safety and distress requirements that apply to them remain controlling.

Fuelling safeguards

An aircraft containing petroleum in bulk may be housed only in a suitable non-flammable, ventilated hangar managed by a competent person responsible for fire safety and access control.

Modifications, ground lights and false lights

A modification or repair affecting the safety of an aircraft with a valid certificate of airworthiness must be approved or deemed approved by DGCA. A manufacturer's approved modification may receive deemed approval unless DGCA requires a separate approval. Aeronautical beacons and ground lights may not be installed, maintained or altered without the required written Government approval, and deliberate or negligent interference with them is unlawful.

A false or confusing light within 5 NM of an aerodrome or aeronautical beacon may be ordered extinguished or screened. This includes a lantern, laser, strong beam or other light that resembles a navigation aid, creates glare, confuses visual guidance or otherwise endangers an aircraft. The owner complies immediately and may then use the prescribed appeal route.

Licences, log books, aerodromes and operators

The Aircraft Rules connect individual competence with organisational control. They regulate licence eligibility and renewal, flight-time records, aerodrome licensing and the manuals used by operators.

Age, crew and medical control

The minimum age for sole control is 16 years. Bali states a general maximum age of 65 years for a professional pilot in commercial operations. Between 60 and 65, the operation is multi-crew with the other pilot below 60, subject to the stated exception for a single-pilot aircraft not exceeding 5,700 kg in India.

Licences are issued or renewed by the Central Government or DGCA. A private aircraft requires an appropriately licensed private pilot, and public transport or aerial work requires a CPL or ATPL holder. An instructor needs the appropriate rating or DGCA authorisation. The need for a flight navigator, flight engineer or flight radio telephone operator depends on the aircraft and operation.

Aircraft registration is divided in Bali's summary into Category A for aircraft owned by Indian citizens, eligible Indian companies, Government bodies or qualifying leases to Indian entities, and Category B for aircraft owned by non-citizens or businesses in India. A change of ownership is notified to DGCA. No operator assigns a person as flight dispatcher without prior approval of the Director General.

A licence may be refused, suspended or cancelled for habitual alcohol or drug use, criminal use of an aircraft, irresponsible safety conduct, serious conviction or false licensing information. A required licence or rating is issued or renewed only after examination by an approved medical authority. Illness or injury that prevents duty for 15 days or more, or any condition affecting safe performance, requires immediate reporting and a fresh medical clearance before return.

Log books and flight time

Each licensed flight crew member keeps a personal log book in the official form. Entries are made permanently in ink and retained for at least five years after the last entry. The holder certifies accuracy monthly, instructors certify student entries for training flights, and an authorised official certifies the book quarterly at the ends of March, June, September and December. Records must not be destroyed, altered or falsified.

Pilot-in-command time, co-pilot time, student solo time, instructional time, dual instruction, supervised duties, instrument time, simulator time and specialist crew time are logged in the category that matches the role actually performed. A student logs pilot-in-command only when sole occupant; instrument flight time is logged only when the aircraft is flown solely by reference to instruments in actual or simulated instrument conditions.

Aerodromes, DGCA directions and operator manuals

An eligible Indian citizen, company, Government body or registered society may hold an aerodrome licence. The application is made to DGCA in the specified form with the Aerodrome Manual and supporting evidence. Under Rule 133A, the Director General may issue directions through Civil Aviation Requirements, the AIP, Aeronautical Information Circulars, NOTAM and notices to owners or maintenance engineers. A draft CAR is placed on the DGCA website for 30 days for objections and suggestions before final issue.

A scheduled air transport service needs Central Government permission and compliance with the relevant Schedule. New routes, major route changes, discontinuance and new timetables require DGCA concurrence, with at least seven days' prior notice for the stated change. The approved Operations Manual defines crew duties and command succession, normal and emergency procedures, safety minima, communication, navigation and radio-watch requirements, and relevant parts are carried on every flight.

A pilot sees national law through several instruments. They do different jobs: a CAR sets a continuing regulatory requirement, the AIP publishes lasting aeronautical information, an AIC explains significant information of a broader character, and a NOTAM gives time-critical operational information.

Prohibited and restricted airspace over India

A prohibited area protects a place where flight is barred except under the authority stated by Government. A restricted area permits flight only in accordance with specified conditions. Exact lateral limits, vertical limits and periods of activity are taken from current Indian aeronautical information.

If entry occurs inadvertently

Follow the published contingency and air traffic instructions. Bali's Aircraft Rules summary directs a pilot who has strayed into a prohibited area to signal distress, leave the area and land at the nearest aerodrome, without flying farther into it or beginning descent while still over the protected area.

Drones, customs, health and specialised rules

National aviation law also protects borders, public health, security and people on the ground. Bali places these specialised rules alongside the Aircraft Rules because each can affect whether a flight, aircraft or payload may lawfully operate.

Drone Rules 2021 and UIN

The Drone Rules, 2021 replaced the older unmanned aircraft framework with a simpler system of approvals, fees, licensing and permissible uses. A drone requiring registration is entered through the prescribed digital system and receives a Unique Identification Number. Bali's Aircraft Rules summary states that a remotely piloted aircraft system above 250 g requires a UIN, with larger aircraft subject to the applicable DGCA permission conditions.

Customs law

The Indian Aircraft Rules, 1920 provide the customs framework. An international flight normally arrives at and departs from a designated customs aerodrome, except for an emergency caused by accident, bad weather or another unavoidable cause. Prohibited goods may not be imported or exported by aircraft, customs seals must not be broken, and the pilot-in-command must permit authorised examination of aircraft and goods.

Public health

The Indian Aircraft Public Health Rules, 1954, as amended, address infected aircraft, infected areas, isolation and incubation periods. Bali states 6 days for yellow fever and plague, 5 days for cholera, and 14 days for smallpox and typhus. Before landing in India, the commander sends the required health report at least two hours in advance when illness or a quarantinable disease is relevant.

The Airport Health Organisation works under the Directorate General of Health Services. Its functions include quarantine referral, disinfection and disinsection, sanitation and water oversight, yellow-fever vaccination, public-health clearance of human remains, aircraft medical emergencies, food inspection and action during a Public Health Emergency of International Concern.

Human remains of persons who died from specified serious diseases may not be brought into India uncremated; sealed ashes are permitted. Other uncremated remains use the prescribed hermetically sealed metal shell, wooden coffin and zinc-lined outer case. Dumping disease-causing matter is prohibited. Bali states a public-health penalty up to three months' imprisonment, a fine up to Rs. 1,000, or both.

Bali also distinguishes the two volumes of the Aircraft Manual India. Volume I gathers national Acts and rules, including the principal aviation, customs and related rules. Volume II separates national conventions, rules and Acts in its first division from international conventions in its second division.

The national system is enforceable. Authorities may prevent a flight before harm occurs, restrict an approval, investigate the event and apply the penalty attached to the Act or Rules.

Penalty figures stated in Bali

The 2024 Act summary gives a general penalty of imprisonment up to two years, a fine up to Rs. 1 crore, or both. Slaughtering animals or dumping rubbish within 10 km of an aerodrome carries the stated specific maximum of three years, Rs. 1 crore, or both. Rule 161 links breaches of the Aircraft Rules or DGCA directions under Rule 133A to penalties in Schedule VI. A defence may apply where non-compliance resulted from accident, bad weather or another unavoidable cause, or where the owner, hirer, operator or pilot proves the breach occurred without knowledge or fault.

Legal protections and exclusions

Reasonable flight at a lawful height, or ordinary aircraft noise, does not by itself create the stated trespass or nuisance claim. Officials acting in good faith receive statutory protection. The Act generally excludes military aircraft of the Indian Armed Forces, except for the specified public-health rule-making powers.
